## 1. Scope and seller information

 

These Terms and Conditions apply to purchases made through the online shop at https://www.tarajadebrown.com.

By placing an order, you confirm that you have read and accepted these Terms and Conditions.

 

## 2. Products

 

The shop primarily offers author-signed paperback books. Depending on the options shown on the product page, a book may be supplied with:

 

- the author’s signature only;

- a personal dedication to the purchaser; or

- a personal dedication intended for a gift recipient.

 

Every effort is made to describe and photograph products accurately. Colours and appearance may vary slightly depending on screens, printing batches and the nature of hand-signed items. Minor natural variations in a signature or dedication are not defects.

 

## 3. Personalisation

 

You are responsible for checking the spelling and accuracy of any name or message submitted for a dedication. The text may be shortened or declined if it is unlawful, discriminatory, abusive, excessively long or otherwise inappropriate.

 

Once work on a personal dedication has begun, the order may no longer be changed or cancelled unless required by applicable law. Personally dedicated books cannot normally be returned merely because the purchaser changes their mind. This does not affect rights relating to an incorrect, defective or damaged product.

 

## 4. Ordering and conclusion of contract

 

Products displayed in the shop constitute an invitation to place an order and are subject to availability.

 

By completing checkout and selecting the button that confirms payment or the obligation to pay, you submit a binding order. An automated acknowledgement confirms that the order has been received. The purchase contract is concluded when the order is accepted for fulfilment, payment is confirmed or the book is dispatched, whichever occurs first.

 

The seller may decline or cancel an order before fulfilment where, for example, the product is unavailable, payment is not authorised, delivery information is incomplete, there is an obvious pricing error, fraud is suspected or the order cannot lawfully be fulfilled. Any payment already received for a cancelled order will be refunded.

 

## 5. Prices and taxes

 

Prices are displayed in Swiss francs (CHF) unless expressly stated otherwise. Shipping costs are added separately and shown at checkout before the order is submitted.

 

Brown Dove, Tamara Brown is not registered for Swiss VAT. No Swiss VAT is therefore charged or shown separately.

 

For deliveries outside Switzerland, the recipient may be required to pay import VAT, customs duties, clearance charges or other local fees. Unless checkout expressly states otherwise, these charges are not included in the product or shipping price and are the responsibility of the recipient.

 

## 6. Payment

 

Available payment methods are displayed during checkout and may include cards, TWINT, PayPal, Apple Pay, Google Pay and other methods supported by Wix Payments. Klarna is not offered.

 

Payment is due when the order is placed. Payment processing is subject to the terms and security checks of Wix Payments and the selected payment provider. An order may be held or cancelled if payment is not successfully authorised.

 

## 7. Shipping and delivery

 

Delivery is available to addresses in Switzerland, Liechtenstein, Europe and other supported international destinations shown at checkout.

 

Shipping charges are calculated using a tiered system based on shipment weight and destination. The applicable charge is displayed before the order is submitted.

 

Estimated delivery times are:

 

- Switzerland and Liechtenstein: **3–5 working days**;

- Europe: **5–10 working days**; and

- other international destinations: **10–20 working days**.

 

These are estimates, not guaranteed delivery dates. Personal dedications, unusually high order volumes, public holidays, customs procedures, postal disruption or events outside the seller’s reasonable control may result in delay.

 

You are responsible for providing a complete and accurate delivery address. Additional costs caused by an incorrect or incomplete address, refusal of delivery or failure to collect a parcel may be charged to the customer where legally permitted.

 

Risk in the goods passes as provided by applicable mandatory law. Nothing in these Terms limits any protection that cannot lawfully be excluded in the customer’s country.

 

## 8. Customs and international orders

 

International orders may be inspected or delayed by customs. The recipient is responsible for complying with import rules and paying any import VAT, duties, customs-clearance charges or carrier fees imposed by the destination country, unless checkout expressly states that such charges are included.

 

If an international parcel is refused or returned because charges were not paid, the refundable amount may be reduced by the original shipping cost, return charges, customs expenses and other costs actually incurred, to the extent permitted by applicable law.

 

## 9. Cancellation and returns

 

You may request cancellation before the book has been signed, personally dedicated or dispatched. Please email tara@tarajadebrown.com as soon as possible. Cancellation cannot be guaranteed once preparation has begun.

 

As a voluntary policy, an ordinary signed book without a personal dedication may be returned within 14 days after receipt if it is unused, undamaged and returned in its original condition. You must notify the seller before returning it. Unless applicable law provides otherwise, the customer pays the return postage and is responsible for suitable protective packaging.

 

Books made with a personal dedication are prepared to the customer’s specification and cannot be returned merely because the customer changes their mind. This exclusion does not apply if the book is incorrect, defective or damaged.

 

Where mandatory consumer law in the customer’s country grants a statutory withdrawal right, that right remains unaffected. Any statutory exception for personalised or made-to-order goods may apply to personally dedicated copies. Further details are provided in the Shipping & Returns Policy.

 

## 10. Incorrect, defective or damaged products

 

Please inspect the order promptly after delivery. If a book is incorrect, defective or damaged in transit, contact tara@tarajadebrown.com as soon as reasonably possible and include the order number and, where possible, clear photographs of the item and packaging.

 

Depending on the circumstances and applicable law, the seller will arrange an appropriate solution, such as replacement, repair, price reduction or refund. You should not return a damaged or incorrect product until return instructions have been provided.

 

Statutory warranty and consumer rights that cannot legally be excluded remain unaffected.

 

## 11. Refunds

 

Approved refunds will normally be made to the original payment method. Processing times depend on the payment provider and financial institution.

 

For voluntary change-of-mind returns, the original shipping charge is not refunded unless required by applicable law. If a statutory withdrawal right applies, any required refund of standard outbound delivery costs will be handled in accordance with that law. Additional costs for an enhanced or express delivery method are not refundable except where legally required.

 

The seller may wait to issue a return refund until the goods have been received or you provide evidence of return, where permitted by law.

 

## 12. Availability and events beyond reasonable control

 

Products are offered subject to availability. The seller is not responsible for delay or failure caused by circumstances outside reasonable control, including postal disruption, customs delays, severe weather, transport interruption, technical outages, public-authority action or similar events.

 

If fulfilment becomes impossible, you will be informed and any payment for the unavailable product will be refunded.

 

## 13. Intellectual property

 

All website text, book descriptions, photographs, graphics, branding and other original content are protected by applicable intellectual-property law. No content may be reproduced, distributed, modified or used commercially without prior written permission, except where permitted by law.

 

Purchasing a book transfers ownership of that physical copy only. It does not transfer copyright or any reproduction, adaptation or distribution rights.

 

## 14. Liability

 

To the extent permitted by law, the seller is not liable for indirect or consequential loss that was not reasonably foreseeable when the contract was concluded.

 

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for intent or gross negligence, personal injury caused by negligence, fraudulent conduct or mandatory consumer guarantees.

 

## 15. Privacy

 

Personal data is processed in accordance with the Privacy Policy published on this website.

 

## 16. Governing law and jurisdiction

 

These Terms and purchases made through the shop are governed by Swiss law, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods, to the extent such exclusions are legally effective.

 

The courts at the registered seat of Brown Dove, Tamara Brown have jurisdiction, subject to any mandatory consumer right to bring or defend proceedings in another competent court. This choice does not deprive consumers residing abroad of mandatory protections afforded by the law of their country of residence where those protections apply.

 

## 17. Severability and changes

 

If any provision of these Terms is invalid or unenforceable, the remaining provisions remain unaffected to the extent permitted by law.

 

These Terms may be updated for future orders when business practices or legal requirements change. The version accepted when an order is placed applies to that order unless a later change is required by law or agreed with the customer.
